1. Acceptance of Terms
By engaging FAYSAM GLOBAL Trading as FAYSAM INSULATION (ABN: 15 681 066 053) (“we,” “us,” “our”) for a quote, booking a service, or paying a deposit, you (“the Client”) agree to be bound by these Terms and Conditions. This agreement constitutes the entire understanding between the Client and FAYSAM INSULATION.
2. Quotes and Estimates
- Quotes: Provided quotes are valid for 30 days from the date of issue.
- Estimates: If a final price cannot be determined until work commences ( discovery of vermin damage, asbestos, or additional work required), we may provide a preliminary estimate. The final invoice will reflect the actual work completed and materials used.
- Site Access: The Client must ensure safe and clear access to all work areas (roof, subfloor, walls) at the scheduled time. Failure to provide access may result in a re-scheduling fee.
3. Booking and Deposits
- Booking Fee: A booking deposit may be required to secure your installation date. This deposit is non-refundable if the Client cancels within 5 business days of the scheduled commencement date.
- Payment Schedule: For larger projects, a progress payment schedule may be implemented.
4. Pricing and Payment Terms
- GST: All prices are quoted in Australian Dollars (AUD) and include GST where applicable.
- Payment Methods: We accept [Bank Transfer, Credit Card, Cash].
- Invoicing: Full payment is due upon completion of the work, unless prior alternative arrangements have been agreed upon in writing.
- Late Payment: Invoices not paid within the specified terms may incur a late fee of [1.5%] per month on the outstanding balance. We reserve the right to suspend further work until payment is received.
5. Scope of Work and Client Responsibilities
- Pre-Installation: The Client is responsible for:
- Clearing the work areas of personal belongings and obstacles.
- Ensuring our team has access to power and water if required.
- Informing us of any known hazards, including asbestos, prior to work commencing.
- Our Work: We agree to perform the services with due care and skill, in accordance with Australian Standards and industry best practices.
6. Limitations and Site Conditions
- Pre-Existing Conditions: We are not liable for the repair of pre-existing structural defects, electrical faults, plumbing issues, or pest infestations discovered during our work.
- Asbestos and Hazardous Materials: If suspected asbestos is found, work will cease immediately. The Client must engage a licensed asbestos removalist at their own cost before work can resume. A separate hazardous materials assessment fee may apply.
- Thermal Imaging: While thermal imaging is a powerful diagnostic tool, it is not an exact science and is used as a guide. We cannot guarantee it will identify every possible issue.
7. Australian Consumer Law (ACL) and Warranties
- Consumer Guarantees: Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
- Statutory Warranty: We guarantee our workmanship for a period of [2] years from the date of completion.
- Manufacturer’s Warranty: All insulation materials supplied by us are covered by the manufacturer’s warranty. Warranty details are available upon request.
8. Liability and Indemnification
- To the fullest extent permitted by law, our total liability to the Client is limited to the value of the services provided.
- The Client agrees to indemnify FAYSAM INSULATION against any claims, losses, or damages arising from the Client’s failure to disclose known site hazards or from unauthorized access to the work site by the Client, their family, or pets.
9. Cancellation Policy
- The Client may cancel a scheduled service by providing at least [5] business days’ notice. Cancellations with less notice may forfeit the booking deposit.
- We reserve the right to cancel a service due to extreme weather, safety concerns, or site conditions that make the work unsafe or unviable.
10. Dispute Resolution
- If a dispute arises, both parties agree to first seek resolution through good-faith negotiation.
- If negotiation fails, the parties agree to mediate the dispute through a mediator appointed by the [Victorian Small Business Commission] before pursuing any other legal remedies.
11. Governing Law
This agreement is governed by the laws of the State of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria.
